However, a new social justice movement is gaining momentum as it is asking employers to \u201cban\u00a0the\u00a0box\u201d and remove questions about past criminal behavior from applications.<\/p>\n<p>\u201cKnown as\u00a0the\u00a0\u2018Ban\u00a0the\u00a0Box\u2019 movement or\u00a0the\u00a0Fair Chance Act, this civil rights issue is gaining steam,\u201d says Rob Wilson, President of Employco USA, \u201cTarget \u2018banned\u00a0the\u00a0box\u2019 in 2013, and President Obama asked federal agencies to \u2018ban\u00a0the\u00a0box\u2019 as well.\u00a0The\u00a0idea is that stiffer sentencing and drug crimes has greatly increased\u00a0the\u00a0number of people with criminal records, and in turn this criminal record makes it difficult for them to find work.\u201d<\/p>\n<p>However, not everyone is pleased with\u00a0the\u00a0Fair Chance Act. \u201cIn\u00a0the\u00a0wake of workplace violence tragedies,\u00a0the\u00a0idea of ditching criminal background questions seems circumspect to many people. It is estimated that 1.7 million people are injured each year as a result of workplace violence, and critics fear that\u00a0banning\u00a0the\u00a0box\u00a0will only make this number higher,\u201d says Wilson.<\/p>\n<p>The\u00a0employment expert explains that\u00a0banning\u00a0the\u00a0box\u00a0doesn\u2019t mean that employers have no rights when it comes to establishing a person\u2019s character and mental health. \u201cIn most states, you can do a criminal background check on your applicant after a tentative offer has been made,\u201d says Wilson. \u201cBut instead of\u00a0banning\u00a0people outright, you will have time to interview them and find out who they really are, rather than be dissuaded by a checked\u00a0box\u00a0that won&#8217;t tell you\u00a0the\u00a0whole story.&#8221;<\/p>\n<p>However, Wilson believes\u00a0banning\u00a0the\u00a0box\u00a0could potentially give rise to a host of issues.<\/p>\n<p>&#8220;Possible safety concerns are only\u00a0the\u00a0beginning. Not only do criminal background laws vary from state to state, but they even vary from city to city. Employers will have much more legwork when it comes to staying on top of changing legislation, and they will also have to grapple with potential litigation and penalties.
