{"id":2818,"date":"2020-02-18T20:00:42","date_gmt":"2020-02-19T02:00:42","guid":{"rendered":"https:\/\/www.employco.com\/blog\/?p=2818"},"modified":"2020-02-21T20:09:32","modified_gmt":"2020-02-22T02:09:32","slug":"are-companies-liable-to-protect-staff-from-unruly-customers","status":"publish","type":"post","link":"https:\/\/www.employco.com\/blog\/2020\/02\/18\/are-companies-liable-to-protect-staff-from-unruly-customers\/","title":{"rendered":"Are Companies Liable to Protect Staff from Unruly Customers?"},"content":{"rendered":"<p><em>Employment expert weighs in on the landmark civil case McDonald\u2019s workers are bringing against the corporation<\/em><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium\" src=\"https:\/\/www.employco.com\/images\/blog\/Blog_McD.jpg\" alt=\"McD\" width=\"300\" height=\"284\" \/>Research shows that violence at <a href=\"https:\/\/slate.com\/news-and-politics\/2011\/04\/fast-food-crime-why-is-there-so-much-violent-crime-at-fast-food-restaurants.html\">fast food restaurants<\/a> is not an uncommon occurrence, with these establishments facing more than twice the level of violent crimes as full-service eateries.<\/p>\n<p>But how responsible are employers for protecting employees from workplace violence? A group of McDonald\u2019s workers are contesting that their employers have not done enough to protect them from the onslaught of customer abuse that has been rampant at many locations, specifically those located in Chicago, IL.<\/p>\n<p>\u201cWhile the \u2018Fight for 15\u2019 has been at the center of conversations about the fast food industry, a new concern is emerging for these minimum wage workers. A group of 17 McDonald\u2019s workers in Chicago are bringing to light the dangers they face on the job, and asking the fast food giant to do more to protect its staff,\u201d says Rob Wilson, human resources expert, Chicago native, and President of Employco USA, a national employment solutions firm with locations across the country.<\/p>\n<p><!--more--><\/p>\n<p>Wilson says that the McDonald\u2019s employees contend that there is a \u201ccitywide and nationwide pattern\u201d of violence directed either at or around McDonald\u2019s workers from unruly customers.<\/p>\n<p>\u201cThey are pointing to the high incidence of emergency situations at their places of employment, including up to 20 calls to 911 on any given day at one Chicago McDonald\u2019s,\u201d says Wilson. \u201cAnd other statistics show that there have been over 700 violent incidents at McDonald\u2019s locations in the last 3 years.\u201d<\/p>\n<p>The employment expert says that companies are not expected to be able to prevent or predict aggressive behavior from customers, but they do have a duty to provide reasonable support and protection for their workers.<\/p>\n<p>\u201cThis is going to be a landmark civil case,\u201d says Wilson. \u201cIt is going to change the way many companies address fears among their staff, and it would behoove employers to start being more proactive right now, such as by offering increased training to staff when it comes to handling violent customers, as well as offering support and resources to employees such as mental health care in the wake of traumatic incidents in the workplace.\u201d<\/p>\n<p>Wilson also notes that companies who fail to institute safety protocol like security cameras or employers who fail to enforce strict bans against customers who have been aggressive to staff in the past may be held liable in the future.<\/p>\n<p>\u201cMany managers and employers are quick to take the \u2018customer is always right\u2019 approach, but if it means tolerating abuse of your workers, the situation can quickly become untenable and put your workers at unnecessary risk,\u201d says Wilson. \u201cProtecting your staff\u2019s dignity and physical safety when confronted with angry customers has to be as paramount as other workplace safety protocols.\u201d<\/p>\n<p>For more on this topic, please contact Rob Wilson at\u00a0<a href=\"mailto:rwilson@thewilsoncompanies.com\">rwilson@thewilsoncompanies.com<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Employment expert weighs in on the landmark civil case McDonald\u2019s workers are bringing against the corporation Research shows that violence at fast food restaurants is not an uncommon occurrence, with these establishments facing more than twice the level of violent&hellip;  <\/p>\n<p class=\"more-link\"><a href=\"https:\/\/www.employco.com\/blog\/2020\/02\/18\/are-companies-liable-to-protect-staff-from-unruly-customers\/\">Continue reading <span class=\"meta-nav\">&rarr;<\/span><\/a><\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[8],"tags":[],"class_list":["post-2818","post","type-post","status-publish","format-standard","hentry","category-human-resources"],"featured_image_src":null,"author_info":{"display_name":"Employco USA","author_link":"https:\/\/www.employco.com\/blog\/author\/employcousa\/"},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.2 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\r\n<title>Are Companies Liable to Protect Staff from Unruly Customers?
