{"id":3248,"date":"2021-01-08T18:10:44","date_gmt":"2021-01-09T00:10:44","guid":{"rendered":"https:\/\/www.employco.com\/blog\/?p=3248"},"modified":"2021-01-08T18:10:44","modified_gmt":"2021-01-09T00:10:44","slug":"hr-newsletter-dol-amends-employee-tip-regulations","status":"publish","type":"post","link":"https:\/\/www.employco.com\/blog\/2021\/01\/08\/hr-newsletter-dol-amends-employee-tip-regulations\/","title":{"rendered":"HR Newsletter: DOL Amends Employee Tip Regulations"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium\" src=\"https:\/\/www.employco.com\/images\/newsletter\/HR\/Blog\/September20_DOL.jpg\" alt=\"Department of Labor\" width=\"1200\" height=\"545\" \/><\/p>\n<p>On Dec. 22, 2020, the U.S. Department of Labor (DOL) <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\/tips\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> a <a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/WHD\/flsa\/tips_final-rule.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">final rule<\/a> to amend employee tip regulations under the Fair Labor Standards Act (FLSA). The final rule will become effective 60 days after its publication in the Federal Register.<\/p>\n<ul>\n<li><strong>Tip Pooling<\/strong> &#8211; The FLSA allows employers to collect all the tips employees receive into a common employee tip pool, then redistribute these tips among employees in an equitable manner.<\/li>\n<\/ul>\n<ul>\n<li><strong>The Final Rule<\/strong> &#8211; This new final rule prohibits employers from keeping their employees\u2019 tips and specifically prohibits managers and supervisors from keeping any portion of employee tips, including tips from a tip pool. In addition, the rule limits an employer\u2019s ability to implement mandatory tip pools that include non-tipped employees and incorporates a new recordkeeping requirement for employers that do not take a tip credit but collect employees\u2019 tips to operate a mandatory tip pool. Finally, the new rule also incorporates new civil monetary penalties, codifies recent DOL guidance on how to compensate a tipped employee who performs non-tipped duties at work and harmonizes FLSA requirements with <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/government-contracts\/minimum-wage\" target=\"_blank\" rel=\"noopener noreferrer\">Executive Order 13658<\/a> (Establishing a Minimum Wage for Contractors).<\/li>\n<\/ul>\n<p><!--more--><\/p>\n<ul>\n<li><strong>Impact on Employers<\/strong> &#8211; Employers with tipped employees should become familiar with these new regulations and adjust their timekeeping, tip pooling and payroll practices to comply with this rule by its effective date.<\/li>\n<\/ul>\n<p>The FLSA also allows employers to pay a subminimum wage rate to individuals who are engaged in an occupation in which they \u201ccustomarily and regularly\u201d receive at least $30 in tips per month.
