{"id":3360,"date":"2021-04-14T16:45:09","date_gmt":"2021-04-14T21:45:09","guid":{"rendered":"https:\/\/www.employco.com\/blog\/?p=3360"},"modified":"2021-04-14T16:45:09","modified_gmt":"2021-04-14T21:45:09","slug":"hr-newsletter-tip-rule-upcoming-changes","status":"publish","type":"post","link":"https:\/\/www.employco.com\/blog\/2021\/04\/14\/hr-newsletter-tip-rule-upcoming-changes\/","title":{"rendered":"HR Newsletter: Tip Rule \u2013 Upcoming Changes"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium\" src=\"https:\/\/www.employco.com\/images\/newsletter\/HR\/Blog\/September20_DOL.jpg\" alt=\"Department of Labor\" width=\"1200\" height=\"545\" \/><\/p>\n<p>On December 22, 2020, the U.S. Department of Labor (DOL) published a <a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/WHD\/flsa\/tips_final-rule.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">final rule<\/a> to amend employee tip regulations under the Fair Labor Standards Act (FLSA). The final rule was scheduled to take effect on March 1, 2021; however, on February 26, 2021, the DOL <a href=\"https:\/\/www.federalregister.gov\/documents\/2021\/02\/26\/2021-04118\/tip-regulations-under-the-fair-labor-standards-act-flsa-delay-of-effective-date\" target=\"_blank\" rel=\"noopener noreferrer\">delayed<\/a> the rule\u2019s effective date to <strong>April 30, 2021<\/strong>.<\/p>\n<p><strong>Portions Approved to Take Effect<\/strong> &#8211; After reviewing the rule for consistency with law and policy, the DOL announced that it will allow provisions that increase worker protections and earnings to take effect in April, including provisions that:<\/p>\n<ul>\n<li>Prohibit employers (including managers and supervisors) from keeping their employees\u2019 tips, regardless of whether the employer takes a tip credit; and<\/li>\n<li>Allow employers that do not take a tip credit to include non-tipped workers (including cooks and dishwashers) in nontraditional tip-sharing agreements.<\/li>\n<\/ul>\n<p><!--more--><\/p>\n<p><strong>New DOL Proposals<\/strong> &#8211; While some provisions will be allowed to take effect, the DOL also proposed the following changes to the December employee tip regulations:<\/p>\n<ul>\n<li>A <a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2021-06245\/tip-regulations-under-the-fair-labor-standards-act-partial-withdrawal\" target=\"_blank\" rel=\"noopener noreferrer\">proposal<\/a> to expand the circumstances in which the DOL can assess civil penalties and a request for comments on whether to extend the rule\u2019s protections to tipped managers and supervisors; and<\/li>\n<li>A <a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2021-06244\/tip-regulations-under-the-fair-labor-standards-act-delay-of-effective-date\" target=\"_blank\" rel=\"noopener noreferrer\">second proposal<\/a> to further extend the delay for certain penalty provisions, as well as the rule for how to apply tip protections to employees who perform both tipped and non-tipped work, to Dec. 31, 2021.<\/li>\n<\/ul>\n<p>The DOL invites comments on both proposed rules at <a href=\"http:\/\/www.regulations.gov\" target=\"_blank\" rel=\"noopener noreferrer\">www.regulations.gov<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On December 22, 2020, the U.S. Department of Labor (DOL) published a final rule to amend employee tip regulations under the Fair Labor Standards Act (FLSA).
