{"id":4562,"date":"2023-04-13T14:12:24","date_gmt":"2023-04-13T19:12:24","guid":{"rendered":"https:\/\/www.employco.com\/blog\/?p=4562"},"modified":"2023-04-13T14:12:24","modified_gmt":"2023-04-13T19:12:24","slug":"hr-newsletter-telework-and-fmla-eligibility","status":"publish","type":"post","link":"https:\/\/www.employco.com\/blog\/2023\/04\/13\/hr-newsletter-telework-and-fmla-eligibility\/","title":{"rendered":"HR Newsletter: Telework and FMLA Eligibility"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.employco.com\/images\/newsletter\/HR\/Blog\/September20_DOL.jpg\" \/><\/p>\n<p>On Feb. 9, 2023, the U.S. Department of Labor (DOL) published a Field Assistance Bulletin (FAB) No. 2023-1 that includes guidance on how to apply eligibility rules under the Family and Medical Leave Act (FMLA) when employees telework or work away from an employer\u2019s facility.<\/p>\n<p>The FMLA requires covered employers to provide eligible employees with up to 12 weeks of unpaid, job-protected leave for specific reasons related to the health and well-being of themselves and their families. Generally, employers are covered if they have at least 50 employees. Employees are eligible for FMLA benefits if they:<\/p>\n<p><!--more--><\/p>\n<ul>\n<li>Have worked for their employer for at least 12 months<\/li>\n<li>Have worked 1,250 hours during the 12 months preceding the leave<\/li>\n<li>Work at a location where the employer has at least 50 employees within 75 miles<\/li>\n<\/ul>\n<p><strong>FAB 2023-1 &#8211;<\/strong> In <a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/WHD\/fab\/2023-1.pdf\" target=\"_blank\" rel=\"noopener\">FAB No. 2023-1<\/a>, the DOL notes that employees who telework are eligible for FMLA leave on the same basis as any other employees, but for FMLA eligibility purposes, the teleworking employee\u2019s personal residence is not a worksite. The FAB states that when an employee works from home or otherwise teleworks, their worksite, for FMLA eligibility purposes, is the office to which they report or from which their assignments are made.
