{"id":5774,"date":"2025-04-21T15:03:09","date_gmt":"2025-04-21T20:03:09","guid":{"rendered":"https:\/\/www.employco.com\/blog\/?p=5774"},"modified":"2025-04-21T15:03:12","modified_gmt":"2025-04-21T20:03:12","slug":"hr-newsletter-new-form-i-9","status":"publish","type":"post","link":"https:\/\/www.employco.com\/blog\/2025\/04\/21\/hr-newsletter-new-form-i-9\/","title":{"rendered":"HR Newsletter: New Form I-9"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.employco.com\/images\/newsletter\/HR\/Blog\/August2023_FormI9.jpg\" alt=\"HR Newsletter: New Form I-9\"\/><\/figure>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>On April 2, 2025, the U.S. Citizenship and Immigration Services (USCIS) updated its Employment Eligibility Verification form (Form I-9) and the Department of Homeland Security (DHS) Privacy Notice in the form\u2019s <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-9instr.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">instructions<\/a> to align with statutory language. The <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/forms\/i-9.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">revised Form I-9<\/a> is dated \u201c01\/20\/25\u201d and has an expiration date of \u201c05\/31\/2027.\u201d Notably, multiple previous editions of Form I-9 remain valid until their respective expiration dates.<\/p>\n\n\n\n<p><strong>Background <\/strong>&#8211; The Immigration Reform and Control Act of 1986 requires all employers, regardless of size, to hire only individuals who may legally work in the United States. To comply with the law, employers must verify each individual\u2019s identity and employment authorization by completing and retaining the Form I-9.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>Key updates to the Form I-9 include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Renaming the fourth checkbox in Section 1 to &#8220;An alien authorized to work&#8221;;<\/li>\n\n\n\n<li>Changing &#8220;gender&#8221; to &#8220;sex&#8221; in the description of two List B documents in the Lists of Acceptable Documents; and<\/li>\n\n\n\n<li>Adding statutory language and a revised DHS Privacy Notice to the instructions.<\/li>\n<\/ul>\n\n\n\n<p>Starting April 3, 2025, the Citizenship Status selection during case creation in E-Verify and E-Verify+ will change from \u201cA noncitizen authorized to work\u201d to \u201cAn alien authorized to work.\u201d However, employers should note that if an employee attests on Form I-9 as \u201cA noncitizen authorized to work,\u201d the employer must select \u201cAn alien authorized to work\u201d in E-Verify. E-Verify cases will display \u201cAn alien authorized to work\u201d while employees and employers may continue to see \u201cA noncitizen authorized to work\u201d on Form I-9, depending on the form edition being used.<\/p>\n\n\n\n<p><strong>Employer Takeaway<\/strong> &#8211; The updated Form I-9 is currently available for employers to use. Additionally, employers may continue to use prior editions of the form until their respective expiration dates, as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Form I-9 (08\/01\/23 edition) is valid until May 31, 2027; and<\/li>\n\n\n\n<li>Form I-9 (08\/01\/23 edition) is valid until July 31, 2026 (employers using this form must update their electronic systems with the May 31, 2027, expiration date by July 31, 2026).<\/li>\n<\/ul>\n\n\n\n<p>Employers should ensure that the updated Form I-9 is incorporated into their employment verification process by July 31, 2026.\u00a0Employco will begin to incorporate the new form into hard-copy and online onboarding prior to the required deadlines.
