{"id":5832,"date":"2025-06-18T13:23:55","date_gmt":"2025-06-18T18:23:55","guid":{"rendered":"https:\/\/www.employco.com\/blog\/?p=5832"},"modified":"2025-06-18T13:23:58","modified_gmt":"2025-06-18T18:23:58","slug":"hr-newsletter-dol-rescinds-guidance-on-cryptocurrency-in-401k-plans","status":"publish","type":"post","link":"https:\/\/www.employco.com\/blog\/2025\/06\/18\/hr-newsletter-dol-rescinds-guidance-on-cryptocurrency-in-401k-plans\/","title":{"rendered":"HR Newsletter: DOL Rescinds Guidance on Cryptocurrency in 401(k) Plans"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.employco.com\/images\/newsletter\/HR\/Blog\/September20_DOL.jpg\" alt=\"HR Newsletter: DOL Rescinds Guidance on Cryptocurrency in 401(k) Plans\"\/><\/figure>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>On May 28, 2025, the U.S. Department of Labor (DOL) released <a href=\"https:\/\/www.dol.gov\/agencies\/ebsa\/key-topics\/retirement-benefits\/cryptocurrencies\/compliance-assistance-release-2025-01\" target=\"_blank\" rel=\"noreferrer noopener\">Compliance Assistance Release No. 2025-01<\/a>, which rescinds <a href=\"https:\/\/www.dol.gov\/agencies\/ebsa\/employers-and-advisers\/plan-administration-and-compliance\/compliance-assistance-releases\/2022-01\" target=\"_blank\" rel=\"noreferrer noopener\">prior 2022 guidance<\/a> that cautioned plan fiduciaries to exercise &#8220;extreme care&#8221; before they considered adding a cryptocurrency option to a 401(k) plan\u2019s investment menu for plan participants.<\/p>\n\n\n\n<p>According to the DOL, the standard of &#8220;extreme care&#8221; deviated from the requirements of the Employee Retirement Income Security Act (ERISA). Under ERISA, fiduciaries must act prudently and solely in the financial interests of plan participants, among other standards of conduct.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>The DOL further stated that the prior guidance marked a departure from the agency\u2019s historically neutral, principle-based approach to fiduciary investment decisions.
