{"id":6293,"date":"2026-05-14T08:25:26","date_gmt":"2026-05-14T13:25:26","guid":{"rendered":"https:\/\/www.employco.com\/blog\/?p=6293"},"modified":"2026-05-14T08:25:28","modified_gmt":"2026-05-14T13:25:28","slug":"hr-newsletter-occupations-qualifying-for-no-tax-on-tips","status":"publish","type":"post","link":"https:\/\/www.employco.com\/blog\/2026\/05\/14\/hr-newsletter-occupations-qualifying-for-no-tax-on-tips\/","title":{"rendered":"HR Newsletter: Occupations Qualifying for No Tax on Tips"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.employco.com\/images\/newsletter\/HR\/November2021_IRS.jpg\" alt=\"HR Newsletter: Occupations Qualifying for No Tax on Tips\"\/><\/figure>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>On April 13, 2026, the U.S. Department of the Treasury (Treasury) and IRS issued <a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/04\/13\/2026-07104\/occupations-that-customarily-and-regularly-received-tips-definition-of-qualified-tips\" target=\"_blank\" rel=\"noreferrer noopener\">final regulations<\/a> on the \u201cNo Tax on Tips\u201d provision enacted under the <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1\/text\/eas\" target=\"_blank\" rel=\"noreferrer noopener\">One Big Beautiful Bill Act<\/a> (OBBBA). The final regulations are effective on June 12, 2026.<\/p>\n\n\n\n<p><strong>Background<\/strong> &#8211; On July 4, 2025, President Donald Trump signed a tax and spending bill, commonly referred to as the OBBBA, into law. Among other provisions, the OBBBA allows certain workers an above-the-line deduction for \u201cqualified tips\u201d and \u201cqualified overtime compensation\u201d for taxable years beginning after Dec. 31, 2024, and ending for taxable years beginning after Dec. 31, 2028. Individuals must earn $150,000 or less ($300,000 if married filing jointly) in 2025 to be eligible for the tip deduction. The maximum deduction for tip income is capped at $25,000 per year, and the deduction applies only to cash tips, which include tips that are charged and tips received under a tip-sharing agreement.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p><strong>Key Highlights<\/strong> &#8211; The final regulations list more than 70 occupations of tipped workers that may qualify for the deduction.
