Question: One of my employees is asking for a copy of their personnel file. We have copies of warnings and discipline notices in the file. Am I required to give the employee a copy of the entire file?
Answer: Whether you are required to provide an employee with a copy of their personnel file depends on the state in which the employee works. Some states give employees the right to inspect and/or receive copies of certain personnel records, while others have more limited requirements. Personnel files generally include applications/resumes, offer letters, job descriptions, performance reviews, disciplinary documentation, compensation changes, etc., and are typically separate from medical files and Form I-9 files.
